1. joint responsible body
Wieland-Werke AG, Graf-Arco-Straße 36, D-89079 Ulm, is the jointly responsible entity of the Wieland Group for conducting the application process and managing the talent pool. It is legally represented by the Executive Board. Further information about the Executive Board can be found on our website  (https://www.wieland.com/de/impressum).

If you apply for a position at one of our subsidiaries (or if a position at a subsidiary matches your profile stored in the talent pool), the respective subsidiary is also a joint controller (an overview of the subsidiaries can be found at https://www.wieland.com/en/websites_wieland_group).

3. purposes, sources and legal basis of the processing
3.1 Application
We process your personal data as part of your application to assess your suitability for a specific position. If we request additional data or consent, providing such data or consent is voluntary. We use this data to get to know you better; providing it does not affect the outcome of the application process.

  • Legal basis for processing the data required for the application is Art. 6 Abs. 1 lit. b DSGVO, § 26 Abs. 1 BDSG.
  • Legal basis for processing additional data marked as voluntary is your consent, Art. 6 Abs. 1 lit. a DSGVO.
  • Legal basis for processing metadata and log data generated through the use of our systems is Art. 6 Abs. 1 lit. f DSGVO. Our legitimate interest arises from the use of IT systems to optimize our business processes.

We generally collect the aforementioned personal data directly from you. If you choose to import certain data from your profile on a business network (e.g., Xing, LinkedIn), the data provided there will be transmitted to us in accordance with your consent to the network operator.

Providing sensitive data (special categories of personal data) within the meaning of Art. 9 Abs. 1 DSGVO (e.g., marital status that may reveal information about your sexual life or orientation; health information) is not required. Please refrain from submitting such data, as it does not affect your application prospects.

If you nevertheless submit such data (e.g., a photo showing you with visual aids, allowing conclusions about impaired vision, or a corresponding video recording), you expressly consent to its processing. If you are a minor, consent must be provided by a legal guardian.

  • Legal basis for processing special categories of personal data is your consent, Art. 9 Abs. 2 lit. a DSGVO, Art. 6 Abs. 1 lit. a DSGVO.
  • If processing is necessary for us to fulfill obligations under labor law, social security and social protection law, or occupational safety, the legal basis is Art. 9 Abs. 2 lit. b DSGVO.

3.2 Data from Other Sources
We may also collect data from other publicly accessible sources (e.g., your publicly available Xing or LinkedIn profile) to better understand your professional background or to contact you directly.

  • Legal basis is Art. 6 Abs. 1 lit. f DSGVO.
  • If you have provided references and we contact them, this is based on Art. 6 Abs. 1 lit. a DSGVO. Please inform the reference accordingly.

3.3 Talent-Pool
We have established a talent pool in which suitable and interested applicants who cannot be offered a specific position during the application process may be included upon their request.

If a position matching your profile is advertised, we will contact you to clarify your interest in that specific position. Contact is usually made by phone or email using the contact details provided in your application.

  • Legal basis for including your application data in our talent pool is your consent, Art. 6 Abs. 1 lit. a DSGVO.
  • Legal basis for contacting you is potential pre-contractual measures, Art. 6 Abs. 1 lit. b DSGVO.

Willingness to be included in our talent pool does not affect the outcome of the application process.

3.4 Video Application
In certain application processes, we offer you the opportunity to present yourself via a video interview (real-time, live, without recording) or by submitting a recorded application video. If you choose to apply with a recorded video, you may review and re-record it before submission.

We aim to provide you with the option to avoid long travel distances through video applications.

Video applications, whether live or recorded, are an alternative to the traditional application process and are considered equally valid. Participation does not affect your chances in the application process.

  • Legal basis for processing your personal data in the context of video interviews or recorded applications is your consent, Art. 6 Abs. 1 lit. a DSGVO.

3.5 Consent to Sending Contract Documents via Email
With your consent pursuant to Art. 6 Abs. 1 lit. a DSGVO, we offer the option to electronically sign contract documents to expedite the process. The documents are sent via email to the address you provided during the application process. Please note that email communication carries risks, as end-to-end encryption cannot be guaranteed. This means unauthorized third parties may gain access to the documents.
 

4. Recipients of Your Personal Data
We do not transfer your personal data to third parties unless required by law. Service providers who support us in the application process (e.g., platform operators) are contractually obligated under Art. 28 DSGVO to comply with data protection requirements. Additionally, we transfer your data for comparison with sanctions lists and for further processing to cloud providers who provide IT services for us.

If we exchange applicant data or talent pool data with subsidiaries, this is based on a contract pursuant to Art. 26 DSGVO.

If the subsidiary is located in a third country, i.e., outside the EU / EEA, and no adequacy decision exists, we have agreed with the respective recipient on the EU standard contractual clauses and, if necessary, additional safeguards.

5. storage Duration
5.1 Application
If your application is successful, we will transfer your data to your personnel file. If we are unable to consider your application and you have opted not to be included in our talent pool, we will delete your application data four months after the rejection. Any video recordings submitted will always be deleted no later than four months after rejection or hiring.

5.2 Talent pool
If you have opted to be included in our talent pool, we will store your data there for 18 months, starting from the end of your application process (provided no employment has taken place). Please inform us of any changes to your data so that we can contact you if necessary. If you wish to leave the talent pool, you may revoke your consent at any time. In this case, we will promptly delete your data from the talent pool.

6. your rights
You have a number of rights with respect to us as the controller responsible for processing your data, which we outline below:

  • Right of access – You may request information at any time and without providing reasons about the data we process about you.
  • Right to rectification – You may request that we correct any inaccurate data we process about you.
  • Right to erasure or restriction of processing – You may request that we delete or restrict the processing of your personal data at any time. Please note that legal retention obligations may prevent immediate deletion. In such cases, we will restrict processing to the extent possible and delete the data once the retention period expires.
  • Right to object to processing – If processing is based on our overriding legitimate interest pursuant to Art. 6 Abs. 1 lit. f DS-GVO, you may object to the processing at any time with future effect. If the processing is for advertising purposes, no justification is required for your objection.
  • Right to data portability – You have the right to receive the data you have provided to us in a structured, machine-readable format.
  • Right to withdraw consent – You have the right to withdraw any consent given to us for the processing of your personal data at any time and without providing reasons, with future effect.
  • Right to lodge a complaint with a supervisory authority – You have the right to contact the data protection supervisory authority at any time. Our Data Protection Officer will also be happy to assist you.

If we process your applicant data jointly with one of our subsidiaries, you are of course also entitled to exercise these rights with respect to the respective subsidiary.

7. provision of data
If you wish to apply to us, we require the data marked as mandatory. Without this data, we are unable to conduct an application process. 

Providing additional data is not required, and inclusion in our talent pool is voluntary. Neither will affect the outcome of the application process.

8. individual case decision and profiling
We do not conduct profiling using the personal data you provide, nor do we make any automated decisions based on such data.
